Any tips on de facto visa

Nationality Irish Partner Australian
Age 27 Partner 39


I met my partner after living in Australia on a work holiday visa for nine months in May 2009 while doing farm work to get my second year work visa.. We started a relationship in October 2009.
I returned to Ireland soon after as we both had been in long term relationships while been together and we had cost alot of upset
Kept in contact with my partner via skype... some times for over 12hrs a day..
Returned to Australia in March 2010.. started de facto relationship.
Got engaged in July 2010
Second year work/holiday visa for Aus was up in Aug 2010
My Partner and i moved to New Zealand in Aug 2010
March 2011 where still living together in New Zealand and are expecting a baby in Aug 2011

Hope to apply for visa at the end of April 2011 as we have enough evidence of de facto relationship.. joint accounts accounts and living together

My Visa for New Zealand is up the day before our baby is due..We do not want to apart again for months.. My partner can not apply for work visa to ireland due to his age and we can not afford a three month holiday visa.

Worried about getting chest xray due to baby.. Can we get a wave on this??
Do i wait till im requested to get a medical or send one with application??
Where do i apply for police check in Australia??
Is 3months enough time to apply for visa as i wont be able to fly after July??
should i be totally honest and put the fact that we both where in relationships when we met on application form?? Is it easier or cost much more to get an agent/ Visa first to help or to do it alone???

Ok some of these I can help you with:


Worried about getting chest xray due to baby.. Can we get a wave on this?? Yes if you are pregnant you don't have to have the TB xray you can postpone it until after baby is born
Do i wait till im requested to get a medical or send one with application?? wait until they ask you, then you will have a case no. and know exactly which tests they need
Where do i apply for police check in Australia?? the Australian Federal Police National Police Checks - Australian Federal Police scroll down it explains how to do them, cost etc then a link to the actual form
Is 3months enough time to apply for visa as i wont be able to fly after July?? sorry can't help you there
should i be totally honest and put the fact that we both where in relationships when we met on application form??personal choice, personally I wouldn't lie on forms because it can trip you up later during interviews etc. But can't you just list the date you two were actually a couple together without other partners and use this as your date of starting the relationship, because technically it was a "real" relationship then? Or does that mess things up and not make it one year? Is it easier or cost much more to get an agent/ Visa first to help or to do it alone??? There is so much help on the immi website with their booklets and help pages on all the forms you need to fill in and so many people who can help you on forums. Costs for agents are expensive and you have no guarantee of a better result. I have found the embassy to be wonderful in asking for information if they need it and answering emails, again personal choice but you still have to collect and collate all the information to give to the agent so you are pretty much doing your own application anyway!

As for the XRay when pregnant - we have the same problem, our baby is due in August and we have applied in January. Yes, you can postpone the Xray until after the baby is born, as KandK said - BUT this will mean you will not get the visa until after birth, which will mean that you will have to have the baby in NZ.

I called the embassy before I applied and asked whether the XRay can be waived completely (I am not from a high risk tuberculosis country). The person on the phone said it was up to the CO, so I sent a letter along with my application, requesting the XRay to be waived, and also indicating that I had an XRay done for a student visa about 3 years earlier, and whether they could just consider that one. I haven't heard back from them, I hope it works.

You might want to consider doing the Xray during pregnancy, but its up to you if you wanna take the (rather small) risk

As for the relationship that you both have been in when you met - as far as I understand it, DIAC are interested in DeFacto relationships/marriages or relationship with dependents. If you both were only dating someone else (not living together, no joint financial responsibilities), I wouldn't bother putting it on the form. Maybe mention it in your relationship pro forma.

As for the 3 months, it's just a guess, I don't know the processing times in New Zealand - but if it is any similar to other countries, you might not be able to get the visa before July. The embassy told me explicitly that pregnancy is not considered a reason for faster processing Are you sufficiently insured to have the baby in NZ if necessary?

As for the agent, don't bother - your case seems pretty straight forward, take one or two afternoons to put your application together and you should be fine.
