Hi there,
I have some questions regarding my offshore partner visa 309/100. This is seventh month where I am still waiting on case officer. I have 1.6 years of de facto relation and on 11 th august it is going to be two years of our marriage. Now I am not sure whether I will be getting permanent residency straight away. Can anyone tell me that would I be getting permanent residency or it will be temporary partner visa and then I have to wait another one year. My agent said it will be permanent visa coz our marriage of two years meets the criteria!
Please share your knowledge!! 😔

AHC is currently taking 30-31 weeks since date of application to allocate case officers. Below is the link from AHC New Delhi website with the processing time frames:-
CURRENT AVERAGE PROCESSING TIMES - Australian High Commission

"You may, however, be granted a permanent visa without having to fulfill the usual two-year waiting period if:
• at the time you apply, you have been in a partner relationship with your partner for 3 years or more, or 2 years or more if you and your partner have a dependent child of your relationship."

This is taken from the partner migration booklet on page 37. Below is the link:-

According to the information provided in your above quoted post, you have been married for 2 years. Do you also have a child from your relationship?
If yes, then only you will be eligible for subclass 100 directly otherwise you will be granted the subclass 309 and will have to wait for the 2-year provisional time period to become eligible for the permanent visa.

Becky left nothing to add. The immi website has the fact, and Becky copied it and I am sure this question was asked before by me, and Becky has put the answer correctly, which I confirmed form the website.

I am sure it helps a lot, and would urge you to check that link and confirm the answer from there. Exceptional will be if you have a child from your relationship, or you have been in relationship for 3 or more years.
Not 2 years, I guess

Thank you so much! When I applied it was one month short in three years of our relationship, like I applied in feb 2014 and our three years complete in march 2014.Would they still consider for permanent or not. And we don't have any kid yet.

Not sure to be honest.

The requirement is 'at the time you apply, you have been in a partner relationship with your partner for 3 years or more, or 2 years or more if you and your partner have a dependent child of your relationship.' keywords being "At the time you apply..." so on and so forth, not after you apply.
