They asked for sponsor's overseas PCC, AFP and salary slips and employment details and family composition form.

Did you sent email to CO? Yours should be Further assessment.

Is your case complex? Like previous marriage?

Good luck.

Guys my visitor visa has been refused twice. I know it is a long message, I will appreciate your efforts guys, I have tried to explain in detail as much as possible.
So I want to visit my husband while I am waiting for 309 visa which we applied in nov 2018. I maybe have a little complex case as I went on visitor visa in April 2017 and lodged 457 onshore which automatically issued me bridging visa A and I managed to stay on that visa for 14 months for a decision to come through.. (which never came) and meanwhile I got married to my boyfriend (Indian origin - Australian citizen) who i was dating for last couple of years. Then as I wasn’t on a substantive visa, I couldn’t lodge my spouse visa application onshore and had to return to India. On a registered MARA Agent’s advice I tried for a visitor after coming back to India in July last years which got refused due to unemployment.. but I was told that I shud have given some time gap after returning to
India. Later on we decided to lodge 309 Offshore so we lodged that application in November 2018. After than my husband visited me
Here for 6 weeks in December and now I again applied for a visitor visa in March which got refused on the same basis of unemployment. I
Did write a detailed cover letter mentioning my reason for visit which we be our first wedding anniversary on 8th may, and shown my assets here and strong finance evidence as well. Still it has been refused and the reason is mentioned in detail the only reason is unemployment.
Does anyone has any clue.. or any experience in similar situation. ?
I am really stuck here without my husband.. can someone suggest if visitor family sponsor would be a better option for me.?? Or get employed first.. and try with an employment in couple of months. Please help.

Hi, Amarjeet Singh !

There is no specific time for a case officer to be allocated to a partner visa application as there are thousands of applications already in pending mode.
So, in your case, it's about being patient and hopful.

However, you could apply for a family sponsored visitor visa on behalf of your partner. That way, she can come and stay with you whilst her partner visa application being processed, depending on how long she is allowed to stay in each trip.

For instance, if she gets a 12 months visa with the permission of a maximum 3 months stay in each visit, she will need to depart Aus a week before her 3 months stay finishes. And, if she doesn't get 8503 condition on her visa, which stops people to apply for a visa extension onshore, you can apply for her visa extension as well and she will be able to get another 6 months stay and hopefully your main visa is finalized by that time.

Hope this info helps you

Hi Jazzamrit85

Since you have had 2 back to back visa refusals, you only have two options left;

1. You apply for a PAN card, find a job in india, get paid directly into your account, wait for at least 6-8 months, get a letter made from your employer, explaining you have been approved leave for 1-2 month, so that you could visit your partner in Australia. It's actually the only guaranteed way for you to be granted a visitor visa as the case officer probably thinks you would apply for a visa extension during your stay as you previously did, whilst you were there. He/she is not convinced that you have a genuine intention of just visiting your partner and not staying with him, as a visitor visa is not granted as a bridging visa so that you could remain with your spouse, whilst your partner visa is being processed.

They are making unemployment as an excuse to refuse your visa as they don't see any reason for you to come back after your visa expires. So, in order to eliminate this excuse, you need to fulfill this requirement.

2. Your partner applies for a family sponsored visa on your behalf and also provides a statuary declaration in which he takes full guarantee and responsibility that you will come back to India before your visa expiry or they can take away his sponsorship right if you fail to return on time. This may make them assured that you will return back home.

You might be imposed a condition 8503 on your visa if granted, which will stop you to apply for a visa extension. In that case you will have to leave Australia once every 3 months and then you can come back after a week. Make sure you only ask for a 3 months visa and not 6-12 months as they might not consider your visit purpose genuine.

Did you received any correspondence email from CO or immi? If yes, then email on the same email address otheriwse call AHC Dehli and ask them for email address. In short you've to contact CO as I think your's should be Further Assessment by now, not Initial Assessment.

I also don't think your case is complex, if you've never sponsored first wife and also mentioned in forms regarding divorce. Then it should not be complex.

Good luck friend. I know waiting is painful.

Share here if you have any updates of your application.

Amarjeet Singh, I also got automated email exactly after one year that your application is in progress. I think applicants who get this email, are those whose applications has been put on extra checks, hence resulting in longer processing than normal. This is just my thinking, as applicants who didn't get this automated email after one year, gets their visa soon.

@Aus8882: If you've any input on this (application in progress email after 1 year) then please let me know.

Thanks all.

Good luck.
