Congratulations on the engagement

You can apply for the partner (309/100) visa before you get married but only if you have an intended date of marriage in the near future which MUST be before your visa is finalized/granted.
Submitting the application in now means that you will need to send your marriage certificate, wedding photos and other updated additional evidence at the time when your application is allocated a case officer. And you won't have to wait for 12 months from after you get married.
You will certainly save good few months if you apply before.

Yes, you care absolutely correct. PMV is not suitable for you since you are going to be married before the PMV is finalized And on the PMV the applicant must not get married before validating the visa by making the initial entry into Australia. After the visa is validate the visa holder can get married anywhere in the world.

Hope this helps. Good Luck!
Please do keep us updated and feel free to ask if you have more questions

Kind Regards,
Becky
Thank you so much for the info and sorry for replying late....

cheers,

Hi everyone
I am new here but will like to discuss about my visa 309/100
Lodging date 11/10/2013
From Australian high commission New Delhi
Case office allotted 15/ 03/2014
After that she disappeared
Then I contact high commision and in aug 2014 , new case officer is allotted
19/aug/ 2014 asked for more documents
All the documents were submitted by 9/10/2014.
After that no reply from high commission, so today I called them, and they said they will get back to me by the end of the day. So I received email , which says I got new case officer , yes this is third officer and then she said she is actively working on my case.. So my question is that why I have been allotted different case officer after few months and what you guys reckon that this activeness of her will take how long to grant me a visa? I am very worried, please reply

Hey guys

Just want to say thanks for all the useful information.
I guess dreaming of a 3 month processing time is just that...dreaming.

Anyway I'm hoping my 189 is processed by Jan so we can get cracking on our PMV.

I have a couple more questions though...

While waiting to apply for our PMV is there anything we could get done whilst we wait...for example getting my partners health check done? or is this only something that's initiated once the application has gone through?

Also this might be a stupid question but while we wait for our PMV we will prob start organizing our wedding. Would it nullify the PMV application if we were to get married prior to attaining the visa?

Thanks!

You should not get the medicals done too early as they are only valid for 12 months.

All you can do while you are awaiting for your PR is to start gathering all your evidence.

In regards to marrying before PMV. If you do this then you have to change to a 309 and also provide extra evidence like joint bank accounts etc.

Thanks for your help Mish
Just adding to what Mish said- both medicals and PCC are valid for 12 months and it is advised to not get them done until requested by the case officer. With the increasing processing time frames of PMV and partner visas, it's best to wait till the department contacts you.

Getting married before PMV is granted- If you get married before the PMV is granted, you can change the PMV application to a partner visa application by updating the immigration by submitting a completed form 1023- Change of Circumstances as soon as you get married.

But if your PMV is granted the applicant will have to validate the visa first by making the initial entry only after which you can get married (anywhere in the world).

Hope this helps. Good Luck!

Kind Regards,
Becky

From what you said, seems yours too unless of course, she may be here and you are living together, in which case maybe there are other options. Good luck!!!

Hi,
Thank you so much for the info..

AHC New Delhi's speed of visa grants has unfortunately slowed down with a few festivals during this week. They will closed from Thursday and resume work as usual on the following Monday October 27, 2014.
Hope this helps. Good Luck!

P.S.- What kind of visa have you applied for and when?
Thanks!

Kind Regards,
Becky
