Hello Becky,
I have applied for Partner Visa(309/100) in March 2014. I stayed in Australia from April'14 to Oct'14 with my Visitor Visa. Now staying offshore. How much more time will it take for case officer allocation of my visa? Will my application be processed when I am holding Tourist Visa? Could you please update me regarding this?

Bridging Visa A since February 2014

Hi everyone , new here .. Im confused regarding my status here in au .
I arrived Australia november 28 ,2013 on a visitors visa .I lodged an extension of my stay last February 7 ,2014 and until now i am under Bridging visa A.Am i not breaching any conditions where i am staying here for almost 12 months since the day I arrived ? An the other thing, me and my partner who is an australian citizen is planning to lodged another visa that i could stay here with him for good.. We are in a relationsh for 2years and 9months now and we are living together since the day i arrived in australia so its almost going to a year now, we dont know what would visa we would fit in as he is still married with x wife, but living seperately for 4yrs but planning to get a divorced soon.. Is there any chance we could apply for another visa onshore ?
Please anyone help ? Im stressed with this . i dont wanna be apart from my partner ..

Have you checked VEVO to double check you are still on a BVA? It seems strange to be waiting such a long time for a decision on a tourist visa extension.

Not being on a substantive visa it is best that you speak with a registered migration agent. Applying from a non substantive visa for a partner visa is complex as in majority of cases you need to get a schedule 3 waiver which is very hard to get.

Your best bet may be applying offshore after you have lived together 12 months (and can proove it) or register the relationship. Then after you lodge you can apply for another tourist visa and hopefully it gets approved and you can be in Australia while the visa is processing. You tell the case officer you will be in Australia and then they will tell you when a decision will be made so you can leave.

yep ive checked it there and im still on BVA.. ive got some delays because of my medical issue regarding my chest xray , they said they seen scar with my lungs but ive never got any tb issues from past . i will have an xray appointment again this coming december 15 , .

If you're on a BVA still, that's great. You need to wait until they decide your tourist visa extension (though with you already having been in the country so long I'm not sure how that would go for you). If they say yes, and your tourist visa has no "no further stay" condition, then you can apply for the Partner Visa from that visa. If they say no, then you have to leave the country and apply for the 309 offshore. Unfortunately there is very unlikely to be an option that allows you to stay onshore to apply for the Partner Visa if they either deny your tourist visa or put a No Further Stay on it. But like has been said on other threads - a consult with an agent is a good idea.

I am waiting for partner visa applied on march 2014 submitted online. Anyone please help me how much time will it take for CO allocation and which month application is being processed now ?

Hey Archu,

As per current trends AHC New Delhi is taking between 36-40 weeks to allocate case officers to applications. Good news is that they have started processing March 2014 applications and some applicants have been granted their visas. Currently both February and March applications are being processed.

Did you apply online or submit a paper application? Online applications are taking a bit longer than paper because there aren't many case officers who seem to have been trained to process the online applications.
