Partner Visa (309/100) Timeline from India- Australian High Commission New Delhi

Hey Everyone!

Hope everyone is doing well.

Thought its about time to start a thread for applicants of partner (309/100) visa from India. There have been quite a new members from India who have been looking for answers to the very frequently asked questions.

Following is application processing/procedure 101:-
1:- Once VFS delivers the applications to the AHC New Delhi, AHC takes a couple of days to put the applications in some sort of sequence. Then they start sending Acknowledgement Letters of the applications to the applicants.

2. When medicals are requested, book an appointment with your nearest Panel Doctor (usually they will be able to book you in 2 days from the day you call). Below is the link from DIBP website which has a list of Panel Doctors in India:-

The 'Medical Request' letter sent by AHC will have your HAP ID which is linked to your passport.
The applicant must log-on to the 'eMedical' portal to generate their "REFERRAL LETTER". The link to the eMedical portal:-

You need to fill out the details requested by the page and click on "LOGON"
The system will generate you the above mentioned referral letter. This is important as it facilitates in tracking the processing of the medical reports online.
Below are the documents you need to carry with you on the day of appointment (also check the document requirement from the medical center you will be visiting):-
1. Original valid passport (and a photo copy);
2. AHC's Medical Request Letter;
3. eMedical Referral Letter;
4. 4 latest passport size photos;
5. Form 26 and Form 160 is provided by the medical center. (you can fill it out in advance and carry it with you, if you prefer);
6. Medical Examination Fees (varies from center to center)

Cases with no complications get submitted to the DIBP within 5-10 working days, the applicant can logon to the eMedical portal and this time the system will generate a PDF titled "INFORMATION SHEET" which will have the date on which the applicant's reports were submitted to the DIBP. The PDF will read as follows:-
"Health Case Status
This health case was submitted to DIBP on DD MONTH YYYY."


3. The best time to apply for a visitor visa to Australia is right after you submit your partner visa application. As per the AHC New Delhi website, the current processing time frame for visitor visa is 15-20 working days and 1 month as per DIBP global service standard.

4. If you plan to stay offshore, better get a hobby or find something to do that will keep you occupied for at least 9 months since date of application or you will lose your mind waiting for the visa.
As per current update, AHC New Delhi is taking 35-36 weeks since date of application to allocate case officers to the applications. Below is the link with the processing time frames:-

AHC has started allocating case officers to January 2014 applications.

As online partner applications were opened to the offshore applicants on December 9, 2013 the whole process is a ginormous MYSTERY :confused::confused:

- The case officer allocation time frame when I applied in July 2013 was 10-12 weeks since application. I got my case officer at 27 weeks since application. RIDICULOUS!! increase in processing time frames.

5. You should be hearing from AHC either you are nearing the 35-36 weeks since date of application (250 days at least) period or have completed it.
Now a days the case officers call almost all the applicants to either introduce themselves to the applicants, for a brief phone interview and/or request additional documents so GLUE YOUR PHONES TO YOU BUTTS!!:p:p
They can also contact the applicants via email, depends on the case officer, what they prefer. Sometimes the case officers call the applicants and request the applicant additional documents but forget to provide their email address. The format for the case officer's email for AHC New Delhi is as follows:

***We should cut them some slack as there are 20 case officer working in AHC New Delhi right now.
FOR VISITOR VISA HOLDERS:- This is the time when you PACK YOUR BAGS AND RUN!!!! Leave Australia ASAP!! Many applications (with no complications) get sent to the final queue on the same day the case officer is allocated.
Sometimes AHC will wait for the applicant to get offshore to send the file to the final queue.

6. If you are requested to submit additional documents, it could be either via email, courier/post or sometimes both, again depends on your case officer.
Many applicants ask how to address the envelopes. Below is the format I use:-

7. A new rule that has been implemented relating to Indian PCC is that the Passport Seva Kendras (PSK) will now be asking for the case officer's request letter requesting the PCC before they issue one. I'm not sure if this rule has been implemented in each and every PSK in India. It's a very new rule.
I have attached the format of the PCC issued by the PSK.

8. Another major hurdle that many applicants face is that of adding the name of their spouse in their passport(s).
Many PSK don't require the applicants to go for the passport re-issue but some do. In that case the applicant must get their passport re-issued before they apply for a PCC. The PSK won't issue you the PCC unless you get your passport updated.

*** I'm in the middle of the passport re-issue process (adding spouse's name and changing residential address)
Different PSKs follow slightly different rules so you must contact your PSK to get the updated information.

9. Once all the additional documents are submitted to the AHC, your case officer will assess/study them and if everything looks genuine enough and is satisfied, he/she will forward the application for final decision aka final queue aka final assessment.
You case officer will inform via email which goes along the lines of "initial assessment is completed in your application and your application has now been forwarded for final decision".
As per AHC's current trend, they are taking between 35-55 days to approve the visa since the date the file was sent to the final queue (subject to change depending on the volume of applications in hand).
FOR VISITOR VISA HOLDERS:- If you are still onshore, now is the latest you can get offshore to avoid any delays. If you wait for AHC's notification email to notify you to get offshore, you're in for an additional 2-3 months of agonizing wait.

The above happens when the application in the final queue gets to the top of the queue and the applicant is onshore, AHC will notify the applicant and put the file at the bottom of the final queue.
This is for AHC New Delhi:- the applicant is not granted the visa as soon as they get offshore, they will have to wait for the whole 35-55 days (sometimes even longer) for their file to get to the front of the queue AGAIN!

10. If the applicant is offshore, the SCO will finish he final assessment on your file, if everything goes well, he/she will straightaway approve your visa :D:D END OF THIS MISERABLE PROCESS!!! You can now go and have a well deserved good night's sleep after 7-8 months of torture, PHEWWW!!!!

AHC New Delhi's indicative processing time frame is 8-10 months and majority of cases (with no complications) are approved within the above time frame; which I think is much better compared to other high risk countries..

Another very common questions is:- Can we request AHC to change the initial entry date?
Answer:- No!! Once the visa is granted, it is impossible to get the initial entry date changed.
The initial entry date is expiry date of either the PCC or the medicals whichever expire first.
Both PCC and medicals are valid for 12 months from the date of issue.

I think I've covered almost everything there is to know about this process for applications lodged in India.

Case Officer's Call to Husband

Hey Guys :)

The case officer called my husband today at around 10AM IST and spoke to him for about 10 minutes. She asked him where I was planning on working after I moved to Australia and when I was planning on finishing my Masters degree.

According to my husband it was a pleasant conversation. AND....the case officer also assured him that my visa will be finalized by October 15 since there a few holidays in between from tomorrow. And that he could call/email her if I didn't get my visa by then. She was like, I'm sure you must be excited to see your wife after so long and my husband was like you have no idea!

So hopefully the good news is not too far away, thank GOD!! Really hoping she keeps her word and approves the visa before my birthday. Don't want to be celebrating my 25th birthday moaping and depressed.

AHC NEW DELHI'S SEPTEMBER'S PERFORMANCE​

September has been slower in terms of both visa grants and case officer allocation as compared to August 2014. There were 15 visas granted on the Indian partner visa forum for the last month while August had 25 grants.

I hope October is a more exciting month with more grants and case officer allocations as AHC seems to be falling behind on them. Some January applicants have been waiting for their case officer allocation for over 260 days now. Praying for all waiting and I hope AHC picks up its pace of work especially with 12 days off they'll be getting in this month.

Becky you are almost there . how long would it take for final decision? Btw do we always get notify when the file is sent for final decision?

Yayyyy, Becky! Any day now! I can only imagine how relieved you are going to be, and how much crying there will be, lol. I know what it's like - so many of us do on this forum - because we've been there. As much as I hate seeing you and anyone else separated from their spouse, when I read this forum it makes me hold mine a little tighter every night in gratitude that I'm finally here with him. :) That will be you, soon!

I am relieved to know that we have now reached the final stage of the processing and that hopefully don't have a very long wait ahead of us.
But at the same time I don't want to be too relieved until I get my grant letter in my inbox ;)

Thank you for all your kind wishes and for being there when I needed to vent and for all your helpful advice, I have said this before but I'll say it again, had I found this forum when we applied for our 820/801 in 2012 our application wouldn't have gotten denied and my husband and I wouldn't have had to go through the most painful and depressing 2 years of our lives.

We just are very excited and can't wait to see each other again, get our old life back and plan our future together without having to live in fear of the visa :D
And you said it very correctly that when we see what difficult situations others are going through to get to their partners makes us realise how precious these moments together are and makes us appreciate both our partners, their efforts and all that time they waited for us and life as a whole :)

AHC Phones Now Working!

UPDATE
AHC New Delhi just updated their page again and the "technical issues" notice has now been removed.
Visas and migration - Australian High Commission
The phones are back on now :) They have been out of commission since September 25.
Let's see how long they will be working :rolleyes:

Check...check...and check....feel the same here...our lives are getting wasted just waiting......

Also someone who applied online on the other immigration forum from India who has been waiting for the past 270 days for a case officer allocation called AHC today and was told that they have been experiencing some system/software issues globally and the process has been slowed down because of it. The operator advised the that the issue should be resolved by today 3:00PM, and if it still isn't resolved they will escalate the issue to higher authorities.

Not sure how much of this is true and how is an excuse to dodge the wrath of fuming applicants.

No Incoming Calls to AHC New Delhi

Hey Guys,

The incoming phone calls on AHC New Delhi's phones are not operating as per their website. Below is the exact notice that was put up today:-

Partner/Tourist Visa

Hi,

First time post, I've been reading the forum and have learned a lot of information about processing times for Partner visa,

I got married to my wife in August 2014, and submitted the application to VFS on 25/08.
AHC Delhi, received 27th August 2014.
PCC and Health check haven't been submitted yet, HCAP No has not been assigned, Am I correct this will not happen until a case officer is assigned?

What I wanted to find out was: my Wife, become we got married, visited Australia on tourist visa, she hold tourist visa with 1 year validity, as we are now married, can she go ahead and book tickets and fly to Australia, or does she have to make any changes to her passport? She is not going to change her name, and will travel as per her issued passport. I think it is easier to get the name and passport changed in Australia after getting PR (after 2 years)

Reading the forums, is it correct in saying that approximately earliest time for visa will be 8.5 months.

Also, if she comes to Australia on tourist visa, and is here, how will the AHC contact her, will this be via e-mail or will she have to provide a local number in Australia to them for her to be contacted, who do we provide this to if no CO has been assigned as of now.

I am planning to visit India later this year, as a sponsor if I need to be contacted, how will do they contact me, (same as above question)

Congratulations on getting hitched :) And welcome to the forum :)

I'm guessing by HCAP you mean HAP ID? HAP ID most of the time is provided to the applicant way before the allocation of a case officer. So no your partner might not have to wait for case officer allocation to get her HAP ID. I was provided mine 5 days after I applied. The wait time for HAP ID issuance varies.
Also it is preferred to wait to provide the medicals and PCC until either the high commission requests for them. Especially with PCC, wait until you get a case officer allocated to provide it.

Visitor Visa:- I don't think she should have any issues with her passport not having her married name. I won't be changing my maiden name but my husband's name is in my passport. I have not come across this issue before. Although you should speak to the airline your partner will be flying with to be definitely sure.

Processing Time Frame:- The processing time frames seem to be increasing as there are applicants who applied in January 2014 (been waiting for over 270 days/over 9 months) who are still waiting for case officer allocation to their file. But as per the AHC New Delhi website, the case officer allocation time frame is 35-36 weeks which is definitely not correct and they should update it soon as that's providing incorrect information to the applicants.

During your partner's stay in Australia:- To avoid any kind of delay it is better to get offshore before a case officer is allocated to your application as there has been some cases who have received their visa on the same day they were allocated a case officer.
So if your partner was onshore when a case officer is allocated to her application, she won't be granted her visa because of her being onshore. And her application will be put aside and it will lose it's position in the pile of hundreds most probably thousands of application causing delays which could mean as long as 2 months of additional wait.
Just make sure your partner fills and sends form 929 to AHC New Delhi before she flies to Australia- to change her address if she will be in there for longer than 14 days. And then do the same upon her return to India so the high commission can update her address and also know when she got offshore.

AHC Contacting the applicant:- It depends on their discretion how they want to contact the applicant, by phone or via email or both. They will email you or your partner on the email ID you guys provided in form 40SP and 47SP. They can request you to provide a phone number via email before they call you.

Regarding your visit to India:- You don't need to update the immigration as the sponsor can be offshore or onshore at the time the visa is granted. The AHC is only concerned about the location of the applicant :)
You can inform the AHC that you'll be in India and provide an Indian phone number where they can reach you during your stay or email you requesting a phone number.

Case officers and even all High commissions workers are not mentioned their names in full on the forum. You can just write their initials here, like HR.

But depends on the time between the two communications, according to my understanding. The later seems to be your case officer as the person who is following you up until the visa grant is probably your case officer.

AHC's Never Ending Phone Line Issues

Hey Guys,

There is a new notice up on AHC's website regarding the issues they are having with their phones:-
"8 Oct 2014 - The Australian High Commission's general immigration phone line is experiencing intermittent disconnections. We regret any inconvenience and encourage clients who are disconnected to call back.
This message will be removed when the line is fully functional."

Thank you for your reply,

A few aspects I would like to understand better,

Why do you suggest waiting for the CO to be assigned to get the PCC & Medical done? I thought to avoid delays, I can get everything submitted, as the PCC has 12 Month Validity from date of issue, so hopefully the visa is granted before 12 months are up.
Who would my wife contact at AHC in regards to getting a HAP ID?

What would I need to ask the Airline?
I have purchased tickets and have linked the tickets together that we are flying together, I rang IMMI yesterday and asked them about the visitor visa, and that my wife has put in her partner application, whether she can visit Australia, IMMI said, as long as her tourist visa is valid, no problem.

So as long as she fill in the Form 929, it won't matter where she is located, or the best idea is around the 9th month, to be offshore (back in India).

Hey uday10,

If you have a look at my application details in my signature, you'll see that I submitted both Australian and Indian PCC at the time of application followed by medicals not too long after the PCC submission.
Both the PCCs and medicals had expired and I was requested to provide new Indian PCC by my case officer which was a nightmare in itself and caused me 3 extra months of delay, not gonna go into detail.

What I'm trying to say is that it's safer to wait for a bit to provide the PCC until later/upon case officer's request.
HAP ID- You or the applicant can just call AHC New Delhi and request for it and they'll issue it to you.

You can check with the airline whether or not your partner needs to have your name in her passport. Although I don't think it's going to be an issue since you both are going to be flying together. But still check for the "just in case" scenario. Better to be safe than sorry.

Provide the address where the applicant will be living in Australia during her stay. Basically the applicant needs to update immigration of the change in their address/passport details every time they change the address for a period of 14 days or longer.

So as I suggested in my previous post, submit one before flying to Australia and then get your partner to submit another one when she flies back to India. As per the information on AHC New Delhi's website, it's taking 35-36 weeks since date of application to get a case officer.

But as per their actual trends, case officer allocation right now seems to be taking longer than 270 days since application which is over 9 months, so if AHC doesn't officially increase this time frame on their website, get your partner offshore at the 9 month mark.

309 offshore before marriage?

Hi,

I am new here, and in need of your help and advice.
i am an Australian citizen intending to marry in Feb 2015. my fiance is an Indian national and we had our engagement on sep 2014.

Can she apply 309 partner visa now,stating that intend to marry in the future and submit the marriage documents later?
i am thinking thus we can save some 3-4 months on the processing time of the application.

prospective visa 300 is not suitable for us as we need to get married in india.
can anyone please shed some light on this...

Can she apply 309 partner visa now,stating that intend to marry in the future and submit the marriage documents later?
i am thinking thus we can save some 3-4 months on the processing time of the application.

I am an Australian citizen and met my Indian partner on tour in India. We got engaged officially November 2013 (though unofficially way before then) and we have done the 300 visa. On this visa we can get married in Australia, India or ... anywhere we want. We are not eligible for the 309 as my partner lives in India and so the prospective partner visa was our only route. From what you said, seems yours too unless of course, she may be here and you are living together, in which case maybe there are other options. Good luck!!!

Thank you the quick response,

The tourist visa which my wife holds, is valid for one year, with maximum stay for 3 months, so this would mean she just needs to exit Australia, go to NZ, or Christmas Island, or where ever and then return to get another 3 months.

How does it work when she receives temporary partner visa, does she have to go back to India, as this is where she submitted her application, or does she only need to be outside of Australia?

'3-months stay at a time' condition- I think you the applicant can exit and enter Australia at the end of 3 month's stay. Although I'm not sure how long the visa holder must stay offshore before returning to Australia. You might wanna check with other seniors, just to be sure :)

AHC won't grant the partner visa until the applicant is offshore since you've applied for an 'offshore' partner visa. The applicant must be offshore for both the application and grant of the visa.
If you wait for AHC's notification email to notify you to get offshore, you're in for an additional 2-3 months of agonizing wait.

The applicant is not granted the visa as soon as they get offshore, they will have to wait for for an additional couple of months (sometimes even longer) for their file to get to the front of the queue AGAIN!

From my experience, all the applicants who got offshore and returned to India to await the decision on the partner visa application, got their visas without any delay. While those who didn't and travelled to Australia's neighbouring countries face horrible delays.

It is the safest and the most economical option to return to India since no one knows how long AHC will take to grant the visa after the applicant gets offshore making the wait in say Fiji or New Zealand an expensive and very stressful choice. Average additional delay in the past was for 2 months for those who didn't return to India.

Possible Change in the Visa Processing Method

UPDATE RELATING TO THE APPLICATION PROCESSING METHOD​
There seems to have been some kind of changes in the processing method of AHC New Delhi. From the timeline I follow from the Indian partner visa thread, 6 of the January 2014 applicants have received their visas without their applications being sent to the final queue on the same day they were allocated a case officer (give that all their documentation including PCC(s), medicals and evidence of continuing relationship was provided to the AHC before the allocation of a case officer) and those who WERE requested for additional documents, their visas were approved within a couple of days from when they provided the case officer the requested paperwork.

Means ... on the applications where the case worker gets them and everything is included, or supplied immediately when requested, they didn't send the application on to the final queue, the application was immediately there and then given the visa by the case worker?!!!???

Is there anything in your information to support whether the 6 cases were online or paper or through a Migration Agent?

Do you find people through Migration Agents have better success or is the same?

... For any chance of him being here for Christmas, we need to go to the final queue by 30th October. That's what I am concentrating on. Going to be damn sure all our additional information is ready now. So there wont be any delays at all once the case worker requests - straight to the agent, thanks for playing

I SO hope they don't think anything crazy because of our age difference ...

Oh geez, now the nerves will kick in ....

There aren't many subclass 300 applications on the other forum. Majority are for partner visas. But both PMV and partner visa applications seem to be processed pretty similarly.
Will let you know if I come across any PMVs from India.
