Spouse Visa Offshore UK delayed by security checks

Hi All

I am new to this forum and wanted any guidance/advise that you may be able to give.I am a British Citizen and my wife is an Australian Citizen.I applied for my Permanent Resident Visa in March 2010 and it is now nearly a year and my case worker and her supervisor both say that they are waiting for security clearance and they do not require any further information. What I fail to understand is that being a British Citizen, why has it taken nearly a year for my visa to be approved.

Any advice will be appreciated

It would seem an unduly long delay unless you have dual citizenship of a HR country or have previously been a citizen of a HR country or spent considerable time in one.
If none of those apply and you have no connections with a HR country, you could seek further clarification.

Thank you Wanderer for your reply! I have lived in the UK for the last 27 years and do not hold a dual nationality, I am of Indian Origin born in Kenya. I am a qualified accountant and working at a senior management level and still cannot understand the reason for the delay and have already requested for clarification but the delay is really holding up our lives as I have potential job offers which I cannot take until my visa is granted. My Wife is in Australia and I am in london....Any advise on what action we can take?

You could first request advice in writing [ by email ] as to whether the security check being done is the one that is external to Immi and done by ASIO and if so why?
If they state it is because you are of Indian birth, you could then ask in a suggestive manner whether that is normal for I have noted that though India is a HR country, it would seem that Indians are frequently getting visas granted with 2-3 months processing times.

If you fail to get satisfactory answers, you could address your concerns to the Global Feedback Unit, details on Contact Us – Compliments and Complaints – Department of Immigration and Citizenship
I will be interested to see what response you do get for along with some very short processing times, there does at the moment seem to be such significant variance in processing times way beyond what should be normal.

Security checks

Thank you for your informative reply and I will take the suggested action as we have already been informed that the file is with an external agency. The length of time for the processing of the checks is abnormal for a British Citizen who has lived, studied and worked in England for the last 27 years and I hope the delay is not because of the fact that my parents were born in India and I was born in Kenya
