Smile Registering a relationship help!

Hi all,

I am going to be applying for a de facto partner visa on the last day of my WHV. My partner and i were previously living together in the UK however we dont have much prove of this and therefore at the moment the plan is to submit my visa application on the last day of my WHV.

I had read about registering our relationship and contacted BDM in Victoria but was told in order to register our relationship, both of us would have to be permenant residents in Victoria and therefore i could not apply. However i have read on numerous forums now that this is not necessarily true. Could anyone clear this up for me??

It could be that the Victorian BDM is taking a firmer line on the registration than what is occurring in NSW and even what the Victorian BDM application form indicates for it clearly has provision for someone from overseas to apply as long as they can provide what the form outlines.
There will always be a public service tendency for bureaucrats to align themselves with the conservative side of things when it comes to giving out information on policy.
Unless the policy and their application form has changed, if you do meet the conditions and can establish that you have been residing in Victoria for some time it may well be worth you testing the system by submitting an application.

Applying for the visa without that and being unable to show your at least 12 months residing together relationship and not a few days to a week short thereof, you could see your visa application rejected and your fee lost.
Some people near the end of a WHV take a trip abroad, to say NZ and then return on an ETA so as to have some extra time for looking around as a visitor would normally do.
If that extra time for a look/see also allows you to get the 12+ months up, that can be considered a bonus whereas it may not be your prime reason nor should it be for using the ETA.

Thank you for the reply, i thought that may be the case... So would I be able to apply for a defacto visa whilst in Australia on an ETA? And would I then have a bridging visa so I can stay in the country when the ETA has expired?

Weve only done a covered the east cost as far as Brisbane travel wise, so there is much more that we would like to see and explore, maybe those three months would be the time to do it and at the same time get more time together...

As for the time we were living together in the UK, my partner had been living with me for a while, (he is a dual citizen) and before he was living with me he was living at his parents 3 hours away from my house... So I was wondering whether bank statements showing we were together I.e. In the same place at the same time would back up us staying together at my house in the UK. His bank statements aren't addressed to my house, but will show that he was in my hometown... Or would such evidence be construed as too vague and not really supporting anything?

Thank you in advance for any help you can give...

An ETA does not have a No Further Stay condition on it so if a successful return is made on one, then a bridging visa may be issued when the eta is considered to have expired and that may be a technical point for whilst the ETA allows a stay of only three months at a time it actually has a validity of 12 months.
One way or another I expect that Immi may have a process where it is accepted that expiry is at the three months for issiong a bridging visa but something you could check with Immi.
Re your address thoughts not using accurate information in a visa application is not something I would ever consider a great idea.

Thank you again for your reply...

It's not inaccurate information I was considering using, it's totally honest information but maybe too vague In supporting the fact that he lived with me... It shows he was staying in my home town, three hours from where he used to live but i guess it doesn't show he was living in my house even though that was the case...

We are just going to have to get thinking what over evidence we can provide

I see what you mean now and I think it will be a bit difficult if he has a bank statement with his parents address on it even if it shows your town bank branch if that is what you mean.
If that is the case, you'll want to be looking at other information and searching through your own individual bank accounts for payment of expenses by either for both of you may be one area to look at or any other correspondence he had addressed to your address.

Sorry it wasn't very clear, but yes that is what I meant! I now need to wait for my mum to post me my bank statements then we can start going through and matching everything up... Thank you for your help...
