Does anyone know if an AFP check is required (or will likely be requested) for sponsors who have NOT spent a total of 12 months or more in Australia since turning 16? My husband left Australia when he was 13 and has lived in the United States since 2004. He has not returned to Australia during that time.

Applied 309: 12/02/2018, in Canada.
Visa Granted: 20/03/2018.
Applied 100: 29/06/2020, eligible 12/01/2020.
RFI: 02/07/2020.
RFI Uploaded: 06/07/2020.
Visa Granted: 16/07/2020.

Yes he is an Australian citizen but has been living in the U.S. since 2004. We are planning to relocate to Australia when my off-shore partner visa is granted to be closer to his extended family.

Just want to provide an update:

Visa Subclass: 309
Applied: 10 October 2017
Medical Check and Police Check requested by CO: 8 January 2018

Hopefully this is an indication that the CO is satisfied with the supports we provided (on a high level) and will not refuse our application (fingercrossed!)

Thatís great! Where did you apply from and which embassy processed it?

I applied through the London embassy at start of November and have started hearing of people who applied as recently as October getting approved so hoping Iím not waiting much longer.

We applied online and got the email from the processing centre in Seoul.

Hi guys, This is my first post on the boards (though I have found the information on here VERY useful in getting our application together). I (USA citizen living in Austria with my Australian wife) applied on 17 December online (through the Vienna embassy), my wife was contacted to get her Police Checks on 21 December, all Police Checks submitted on 5 Jan and my application is now "assessment in progress". Let the waiting game begin!

Quick question - I have lived overseas (Australia from 2007-2014 and Austria from 2014-present) and have already submitted my Australian and Austrian Police checks. I have spent less than 12 months in USA in the last 10 years, but is there any chance that a Police check from USA will be requested of me? If so I want to start the process now, since I need to do it from overseas and it takes forever (according to the FBI website).

Hi there,

Based on what I read, it is unlikely you will need police for countries you stayed less than 12 months in, with the exception of you migrating with children.

Congrats! Once you have a case office assigned and cleared the medical and police checks, then will be a matter of waiting for the visa.

We recently got ours. :-)

Did you apply online? Use an immigration agent? Was there any contact from DIBP before your 309 partner visa was granted? I'm curious as to how fast USA applications are being processed.
