We were very upfront about our intentions, i said we are moving as a family to Australia and for the best interest of our kids, we couldn't be separated. I requested a 12 month stay with multiples entries - in case we want / have to travel (to visit my falks in France). I joined a statutory declaration from my inlaws stating we are going to live with them at the start, I joined all the paperwork to show we are in the process of selling our house so we will have enough money for me to stay in Australia and I wrote that I won't be working.

The visa was granted today. Very happy!

Just wanted to let you know! I think you should go this route too so your hubby doesn't have to leave the country every 3 months. Good luck!

Questions
Informed high commission by phone that we are leaving canada (neither one of us cdn), travelling to Australia, hubby is visiting for his 3 months till he has to leave -but he will go back to Italy and wait it out.
What form do I fill in -change of address? Change in circ? Do we change his address to Australia, then again to Italy when or hopefully IF that happens (we hope it will come thru before this is necessary and he'll h across to NZ). I was planning on sending a letter to explain he will leave me and the kids (Aussie) in Oz with my mother. Any clue on which forms to use please?

Hi BrissyGirl, if it were me I'd do the change in circumstances form for sure. I'm not sure about the change of address, that's a tricky one! Which of you is the one applying for the 309 visa, you or your husband?

Hubby is applying 309/100 - direct 100 due to being married 24 years and counting

We filled out change of address, mainly because I was told any time spent 14 days or longer in the one spot you needed too, but they never mentioned the change of circ so who knows really! we did also write a cover letter explaining any travel dates in our waiting time!

That's what I planned to do. Change of address and letter stating what we're doing. The first time I called the high commission they said change of address, and then another when he goes back to Italy. This time around (called today) they mentioned change of circumstance form. If you look at both forms, the address one is really what we need - our circumstances haven't really changed - just our address.

Don't listen to IMMI - they don't generally know what they are talking about!

I would submit this form:

Are there anyone waiting for Visa from China? My husband has been rejected the ONshore Partner Visa and now has to go back to apply again OFFshore! I'm wondering what the processing time will be in China. I'm prepared for 8 - 9 months processing time? Is this correct?

Hi everyone!

I have lodged partner provisional (subclass 309) visa application on 22 September 2013.
Case officer contacted me on 4 April 2014 for additional documents.
On 19 June 2014 CO replied that she is now waiting for character check from Australian agency, time takes 6 month average.
I have send an email to my CO inquiring the status of my visa on 28 December 2014 (after 6 months).
Vice-consul (immigration) replayed on 23 January 2015 that they cannot provide any specific timeline, when my visa will be granted.

So in a nut shell, I am waiting well over 16 months and no one from Australian consulate in Dubai knows whether or not I will get visa. Btw I am from Bangladesh, living in Dubai for 19 years. Me and partner is frustrated.

I have question, if anyone could guide. That is I want to go to Australia for studies. If I apply for student visa, will there be any negative affect or impression on already applied partner visa?

I would appreciate your suggestion.

Thanks

waitingover15month
MAB

It is the security checks that is the hold up and unfortunately the embassy has no idea when they will come back.

There was one applicant that posted this morning and they applied July 2013 and was granted today (maybe yesterday?) and they applied from Dubai ... so 17.5 months waiting.

Hopefully not much longer now.
