We will probably have green cards within the next month or so and, if that is the case, will apply for the offshore visa.

Should we decide that we wish to remain in the USA indefinitely, even after any visa is granted, would that be ok? Is there any hard and fast rule that the applicant must live in or enter Australia at any point to get or keep this visa?

We are planning for the future but not entirely sure what it holds yet.
Yes, there is an enter by date that if you miss, you'll lose the visa. Also, even if you get PR, it only comes with 5 years of travel facility, meaning after those 5 years are up, even though you're a PR holder, you cannot enter Australia. You'd need to apply for an RRV, which you can read about what the requirements are for that on the visa website as far as living in Australia and/or showing significant ties.

1. Application lodged in December 2017 from Malaysia (Partner is from the Philippines).
2. All Police Checks uploaded by January 2018.
3. Status changed to 'Initial Assessment' in March 2018.
4. Sent a letter to local MP on 1st August, 2018 about the unreasonable processing times of 23-26 months. Representations were made to the Minister for Home Affairs.
5. CO (in Malaysia) requested Medical check and AFP check for sponsor on 24th August, 2018 with a 28 day deadline.
6. All checks were uploaded by 4th September, 2018.
7. Found and clicked the "I confirm I have provided information as requested" button in ImmiAccount on 24th September, 2018. Status changed to 'Further Assessment'.
8. 309 visa & 100 visa (we've been together for more than 10 years) granted on 26th September, 2018.
9. Partner has to enter Australia before 31st October, 2018 as that is when one of the Police Checks expires.

Good luck to the rest of you!
Hi,

I don't know if you are still getting notifications from the Australia visa forum or active on the forum, but I'd like you to share what you wrote to your local federal MP.

I have written a draft and keen to get any ideas on making it persuasive.

You can PM me if you don't feel comfortable publicly sharing

Thanks,

CK

You cant know unless you get emailed requesting more documents. If you never have any contact from anyone then there is no way to know if/who is your CO.

And just because you were contacted by one CO doesn't mean that person is the only one on your file. They may never look at it again. I've had one CO contact me but a different one contact me the next time and grant it.

Thanks everyone. We were contacted from Aus embassy in Chile by someone requesting medical exams. I though if previous medical exams are valid it wasn't necessary to do a medical again.

This is intriguing.
Please clarify the following:
1. Did you do the meds without being asked by a CO in an email?
2. How long are the meds valid for?
3. What is the status of meds on your account? I think it should be "no further action required" or something similar.

Hi. We applied for a tourist visa in March 2018 and then lodged resident visa application in April 2019.
1. For tourist visa my partner needed to provide biometrics and health exams which expire in February 2019. We were asked to provide another set of biometrics for the resident visa but 2) I was sure we didn't have to provide health exams until they expired after a year. The email says he doesn't have to do a chest exam but must provide HIV and medical exam. Very frustrating beause it is very expensive and this will be third health exam in 3 years!!! (He was also granted a tourist visa in 2016).
3. Require action but I was told this is an automated response on immi acount so to wait if they contacted me, which they did yesterday.

Alright. Your case is slightly unique.

I think you will have to provide all the relevant medical reports because the visa grant might not come across before Feb 2019 anyway.

We spent a pretty penny on health examination too given that there wasnt even a panel hospital in our city. All in all we had to shell out around 600 dollars on the health check. Since then we have heard only the sound of crickets chirping and nothing else for more than four months.

At this point, I would suggest you count your blessings and be grateful they have accepted the chest x-ray at least. Hope it all works out.
