Hey everyone, I just got granted my 309 visa, just wanted to share my timeline:
Applied Sept 4th, 2018 from Santiago, Chile, with immigration lawyers
Medicals done in October, no contact from immigration
Visa granted on the 6th of May 2019 (Eight months)

Hello

We applied from outside ( Ottawa Canada)

DOL June 6th 2018
Request for more info 40SP Jan 4 2019
100 Granted on May 4th

Date of first entry no later than August 4th, but flying out next week to activate.

Good Luck to everyone still waiting and I hope for some speedy processing.

but can you kindly tell me if the questions on the form 40SP are the same as on the old form as of course we can not see them prior to my future wife opening an IMMI account when ready to do the visa process ?? I assume that , under the new spondor
approval PRIOR to submitting the visa application, the huge $7000 fee is not paid at that stage ! we will see in due course I guess .

I’ve been following this post since we applied for our partner Visa back in August 2018 but have never written anything before. Just to give everybody some hope but I will tell you a little story and how our partner visa was approved against all odds.

My partner is 30 years younger than me.

Although I have been separated for over 5 years, I have never applied for a divorce so I was technically still married.

My partner had overstayed for over 3 years.

He went back home in January 2018.

I applied for a divorce in August 2018 which came through in October or November 2018.

We applied for our our partner Visa 309/100 in August 2018 using a migration lawyer.

In December 2018 my partner had to redo his medical which he passed in January 2019.

He’s police criminal clearance expired on 12 April 2019 so he applied for a new one.

On 26 April 2019 the migration lawyer called me at 7 am to tell me the Visa has been granted.

No interviews, no phone calls, just granted.

The 8 months and 10 days of waiting were probably the hardest time of my life. I was losing it with my partner, I was losing it with my kids, I was losing it with my work colleagues, and most of all I was losing it with my migration lawyer even though I knew that she could do nothing about it.

So how did we do it?

Because he had overstayed, he could not get a tourist Visa so I flew there 14 times in the 15 months that he was overseas.

I obtained affidavits from my kids, from my ex, from my work colleagues, from the priest, and even from my doctor who said that I had lost 12 kg in the time my partner was gone.

We had joint bank account in Australia and we opened another one overseas and I kept updating the department with transfers into the bank accounts and shopping receipts and evidence that I was supporting him and his family.

I bought him a car while he was overseas.

My daughter (who is older than my partner) went there for a holiday with her boyfriend but did not like the resort she was staying in so she gave it to his family to stay in while she stayed in another resort. We then sent evidence of that to the department so they could see family interaction.

Of course with our application we sent numerous photos (taken since 2016) with captions of what each photo was about.

Happy to answer any questions because I truly empathise with all who are still waiting.

Thanks for your story, but there really is no trick to this or magic bullet approach, its dumb luck and where you are applying from mostly.

I've been waiting over 12 months now and have been married to my partner for 5 years, we have piles of evidence and a shared residence, 100's photos over the 12 years we have known each other.

A very straight forward application with no over stays or other complications...The waiting continues.

My partner has been with me for nearly 2 years. We've been waiting since june last year and the stress on the relationship is there. Only because the waiting is just completely unfair. I've supplied hundreds of pages of evidence and photos. Financial support every week, and still no answer. Others which seem to just get it straight away.

We've followed every letter of the law, no violations or overstays, and still no progression.
