This is my story and apologies to anyone for taking much of their time <img src="http://www.australiaforum.com/images/smilies/smile.gif" border="0" alt="" title="Smile" class="inlineimg" />

My husband is an aussie citizen and we got married in aug 2018 and applied for 309 spouse visa in mid Dec 2018. we had a migration agent in aussie who lodged our visa from aussie. We received an email from the CO in march 2019 to upload more pictures and original marriage certificate, but haven't received any news from immigration till date, or been called for interview.

However my husband and i had a few misunderstandings since 3months and now he doesn't speak to me. He said that he has filed for divorce in my home country as we got married in my home country, but i have not received any divorce papers yet, and that he has withdrawn my application as we didn't receive the visa grant by then.

Could anyone please help me with the below information? I am really desperate and would be really grateful.

1. He said he has withdrawn the application on June 28th. If he has, would the DIBP notify me or the agent? and if so, would the migration agent be obligated to notify me as i'm the applicant?

2. Should I inform the migration agent of this situation? as she never contacted me to ask anything about what happened between me and my husband. I'm not 100% sure that he has withdrawn the application as i didn't receive any news from my agent or DIBP

3. Is there anyone who has applied in Dec 2018 and received their 309 visa grant?

I've been trying to reconcile with my husband, but he doesn't answer or reply to any of my messages. I really want to work it out with my husband, and I'm praying that he hasn't withdrawn the application and that it will come through soon.

I appreciate anyone who can really give me an advice on what i can do.

Thank you!

Since used a migration agent, i suggest u ask the agent about it first, whether the application has been withdrawn or not

Some yes, but not all of them.. Need to be aware that some applications from most countries can take over 2 years.

Actual figures show that there were 254 Provisional Partner visas granted at Pretoria office (2017/18) in a median of 331 days.
ie: 127 took under 331 days, while 127 took over.

Pretoria seems a bit faster than Washington USA, where there were 502 Provisional Partner visas granted in a median of 358 days. (27 days longer for the median)
ie: 251 took under 358 days, while 251 took over.

Hi,

I am really sorry to hear about your situation. Hope things works out soon between you and your husband. I can answer a few of your questions.

1) If the application has been withdrawn, you shall be notified by mail. Mostly in your case, your agent would have received the mail. Also it shall appear as withdrawn status in your immi account. The agent may have informed your husband about the same.
I suggest you call the agent and find out as they will know for sure.

2) If the application has been withdrawn then your agent will already know. You can call and ask them about the status. I guess it depends on you if you want to let the agent know about your current situation. However, you have paid them so they shall help you with it.

3) I guess you have applied onshore? If so, then there is a forum for onshore applicants, you can check there.
If you have applied offshore then it depends on your country and their processing times.

Hope this helps. Take care.

this is very unfortunate situation marrying in August and divorcing before even anniversary date! Distance is bad for relationship. stay strong girl!
about your question
if he has withdrawn you should receive an email on the address you provided!
you should ask your agent about it, shouldn't hide it at all.
and I don't think it's time to get grant yet or depends where you applied from. myself waiting since July 2018 from new delhi.
I'm not an expert or anything, I could be wrong too.

Yes one. This is the thing looking at people who applied at this poor guys office, i noticed it seems to be normal for them to wait 20 months. My fiance wld be at that office to if he were in his home country and guess how long he has been waiting...... ok i was being dramatic earlier. But i see uk streams, even canadian and they talk abt the lengthy times (which are quite short compared) usa i never saw. N your right its only a small group. Do not know what's going on in washington.
Just makes me mad. N then you eating up what the gov says is like ahhh...
But i am frustrated as i want him here with me.

Hi,
Thank you so much everyone for the feedback! it was helpful!

I know that I can ask the migration agent, but the other problem is that she is very friendly with my husband. I'm worried that if i ask her about it and she will tell him. and that in case if he hasn't withdrawn the application, maybe there might be a chance that he may actually withdraw it. I'm still trying to make it work between us, because i really want it to.

it is very complicated, i know

But thank you everyone, for the replies. just praying and keeping my fingers crossed and hoping for the best.
