I was wondering, does 309 visa allows you to travel in/out Australia? On the Migration booklet it is saying that "309 - Provisional visa - Temporary visa allowing a person to enter and remain in Australia until a decision is made on the permanent visa application". Could someone please let me know?

Kind Regards,
Monika
Yes you can come and go as you please. They just mean that the visa is valid until the decision is made on the 100.

Ok great. And how about "If you are an Australian permanent resident, you are required to be usually resident in Australia"? My husband is an Australian resident, but we live/work in the UAE. Do you think this might be the problem? On the other hand, on 40SP form, it says: "If your residential address is not in Australia, please attach a statement outlining how you will meet your sponsorship obligations". I found it contradictory.

It means that if you aren't usually a resident of Australia you need to attach a statement of your plans ie. Job, house etc in Australia. If you don't have plans to live in Australia they will question to why you need a visa to Australia.

KitKaat, I do not know when my Co send my application to the security check. But i did apply in November 2013 and submitted my police check plus form 80 together with my application.
When i ask my Co why my application is taking too long, he says its because the security check is not ready, so am a bit confused
