I'm wondering if you can travel in and out of Australia as a visitor while your application is pending for the 309?
Usually with a visitor visa they want to be sure that you're a genuine visitor and will leave the country at the end of a visit. I'm not sure how that works with 309 though, so I can't help you there. Hopefully someone else can answer it.

I'm also wondering once you're granted the 309, how long do you have to enter the country before the visa is cancelled?
You have until either your medical or police clearance expires (they are valid for 12 months from date of issue), whichever comes sooner.

Many people do get a tourist visa while waiting for offshore partner visas. We got a 12 month visitor visa while waiting for the 300 PMV.

apply for second stage 100 while not moved to Aus yet

Hi everyone, I m new to the forum and have been reading the informative threads so far. Would like to check if it is risky for my second stage visa (permanent visa 100) to be lodged when me and my husband have not moved to Aus by then.
My visa 309 was granted in Oct 2016. I am making my first trip to Australia this month to satisfy the first entry requirement deadline set for July 2017. However, this trip is for us to go for job interviews there as we have not secured an employment in Australia as of now.
My eligibility date for permanent visa 100 is in May 2018 and my question is - do my husband and I have to be in Australia in order to submit the permanent visa 100?
Understand that the Australian DIBP has pretty strict guidelines on usual resident of Australia, I am quite concerned that by May 2018, if we have not gotten a job there, we might not be able to move as yet, which might have negative impact on my application.
My husband is an Australian PR since April 2014. Would this status cease if we have not moved there by may next year?
Would be glad to hear any insights/experience from you
Many thanks in advance

309 Average waiting time

Hi everyone in here. May I know how long does it take normally for 309 visa get approved?

I got married with my Australian partner on 10 Jul 2016 in Australia. We're currently living in Indonesia. My husband has been working in Indonesia for the last 4,5 years. I used to live in Australia for over 4 years under a student visa before I came back to Indonesia 2 years ago and met My husband here.

I lodged my 309/100 visa application on 31 Oct 2016 but wasn't be able to complete the x-ray requirement as I was pregnant. I finally completed my medical requirement on mid Dec after I had a miscarriage. On 21 Dec 2016 they asked me to provide more documents and I provided all the documents by 3 Jan 2017.

Until now I didn't hear anything from them yet. My husband will finish his work contract on mid June and will go back to Australia. At this point I can't make any decision to fly back with him yet as I'm not sure how long until my visa finally get approved so we don't have to be separated.

As what I know, for 309/100 the condition is you have to be overseas by the time your visa decision is granted. I'm not sure with PMV one. Anyone know more information about this?

You have to be overseas when both partner visa 309 is granted and PMV300. However your case officer should tell you when they are ready to finalise the visa application if you are in austalia at that time. I know because it just happened to me. We went overseas a few days later (not home country) and received the visa while there. We came back 6 days later.

Hi, thanks for that. I emailed the embassy 2 days ago and they told me so too. I can travel to Australia under a tourist visa and they'll let me know once my 309 will be finalised so I can make an arrangement to be out of country for them to finalse it.

Another useful information from them that maybe other people who's waiting want to know. They're currently (this month) finalising an applications that were lodged on August-Sept last year (Jakarta office). So they told me I can count by myself when is my application will be finalised. Mine is end of Oct, and this month they're finalising the one from Aug-Sept 2016. Yay.
