workcover 487 / 887

HI Mark

I am on 487 visa. my visa granted in may 2013. I started full time job in regional before grant of visa in April 2012. I got hurt at work in July 2013. I am still on work-cover and not seen myself getting better. I am getting paid as full time employee. I want to know
- have i completed 1 year full time work requirement for 887 visa.
- when can i apply 887 or Not

I can't find anything that defines "work" for this particular purpose other than a general definition. I'd say that time covered by holiday pay, sick pay etc. all counts, but I cannot be sure about the time spent on Worker's Compensation.

The best idea would be to contact the DIBP and get advice from them in writing. Do not rely on advice given by phone.

Maybe one of the other agents on this forum has come across this situation before and can provide a definitive answer ?

Thanks Jeremy, I could not find anything either. There could be some MRT cases that will shed a light on this issue, but I haven't had time to check.

Hi

I called DIBP the operator told that it should be considered full time work if payslip says full-time . I asked for written...or PAM reference... they sent my inquiry to policies Canberra.

How long does it take for Canberra to reply..

It would normally take 2 weeks to a month. Even longer if they are busy. They do normally respond. I asked several of my learned colleagues as the Migration Institute of of Australia's annual conference in Perth last Friday and was not able to get a definite answer, though most said they thought it would count as full time work. Please let me know when you get you answer from Canberra.

Hi All

Just got a call from Sydney DIBP.
i have been told if my work cover payslips say full time.
I am considered to have met my full time work conditions..

they have left note on my 487 file.
this is done after getting a confirmation from canberra.

So happy.

That is good news. I will pass that around to my colleagues as needed. Maybe it will be included in the Procedures Advice Manual next time it is published.
