Checking Process

Dear All/Super Moderator;

I have had applied for Visa 176 Category back in August 2009.My application is currently under Priority 2 as per WA SMP.Since one and half year as and when I enquire about my application's status-I am being informed that my application is under checking process.

My question is that as I belong to an HR country,is this the reason or they are going to refuse .But in either case why are they taking so long in the checking process,they should better take a decision.What should be the potential reason underpinning such a long checking process.

I would appreciate in detail answer.

I guess they mean that they are checking your background. If you are from a high risk country, they probably asked for a form 80. This is handed to ASIO, the Australian version of the FBI, who searches for any links you, your family and friends may have to any terrorist or crime organisations.

Unfortunatley, ASIO does all the background checks on asylum seekers as well. We have had a lot of people try to enter Australia and seek asylum over the last couple of years, but they have to be checked first to make sure they are not a danger to Australia. ASIO admits they are having trouble processing cases on time.

I am not saying you are a terrorist just because you are from a highrisk country, but you have to understand that your country is highrisk because a lot of terrorist activity may come from there.

I know it's frustrating, but please try to be patient. Maybe you could try contacting ASIO yourself. Complaining to DIAC won't be helpfull because they don't handle this part of your application.

Thanks for such a comprehensive reply!

DIAC is right in doing whatever they could,anyways as per my information ASIO or DIAC have had not as of now contacted my current/previous employer for confirmation of employment references.

Furthermore the Case Officer was telling me in recent communication that they are not entitle to ask about the status of checking process or the estimated time left in completion of the same.

Moreover as you have indicated that I might contact ASIO for the enquiry of my application-in this vein please let me know their contacts and what is standard procedure to ask about the same as per ASIO's bylaws.In addition to that how would I identify my application to them,is it through TRN or any other ,please last thing,don't they interpret the direct contact by an applicant as a negative sign.
