Sub class 309 visa need help

Hi
Is there anyone that has lodged a form 47sp &40sp for a partner visa at
The Berlin Office? I have tried for the past 1 week to contact them for some inquiries that I have about filling out the above forms, and they reply to me to go to their web page.
I have read the booklet 1 but I have a few questions.

You'll usually find that all Immi offices will refer to people to the website/booklet as their function is only to process visa applications and it is expected that people will either be able to use the published information which is fairly clear or they seek help from forums or use an agent.

There are some questions on application forms which may not seem relevant but still best to put in answer to your best ability, but do double check what is available re help or fill free to ask here.

Hi there,
I have lodged both forms to Berlin. Next to the official booklet, the site of the australian embassy in Berlin has quite a few helpful pages. I can not post a link here but go to: visas and migration, FAQ partner migration, then scroll down to relationship evidence and click the link to 'migrating as a partner'.
It is a step by step guide to prepare you application. There is information for the applicant, sponsor, on evidence and so on. They also want forms that I think are not mentioned in the official booklet (like form 80 and 886). Also Berlin uses their own form for 'relationship pro-forma'. You can download them from the site. Good luck.

I have allready spent hours on that web page, all I need is to contact some official from the department of Berlin for some questions, I have tried all types of e-mails and got now where. Maybe I will have to reach australia for my inquires. See all my family which will be travelling to Aus are Australian citizens and hold an australian passport, only my wife (which we have been maried for 15 years) is a holder of a Greek passport.
Is it so hard for them to reply and ask me what my enquiery is? I really don`t understand and I1m surprised by the Australian authorities that have placed people such people to help Australians with their problems.

Hi there.
What are your specific questions? Are you applying for a partner visa for your wife?
I am sure there is someone out here that may be able to help you.
I don't know if you already did, but you also could try calling the visa office in Berlin? The opening hours are on the homepage. I did it twice and both times i got helpful answers from the staff members working there.

Hi, I was always successful contacting them via phone, the Berlin office has a visa helpline. Even though the website specifically states that they can't give you consultation on your visa application, you'd have to get an agent.

What quesitons do you have about these forms? Maybe someone can help you? I filled and sent off both of them as well.

Yes I have some specific questions, if you can help me... but to make it easier for you I will not put them to you`re atttention in total.
I`m attending to travel for a permanent residence to Australia with my family. My two kids are Australian citizens by descent (and have been granted Australian passports) I also have an Australian passport,but my wife has a Greek passport.
So my wife is applying for a partner permanent visa 309
I have downloaded forms 40SP & 47SP which one is for the Sponser (ME) and the other for the applicant (MY WIFE)

!st Question Cerified copies can they be translated by a registered lawer or only by a public notary?

2nd Question Evidence of Sponsors length of residence in Australia. I have 2 high school certificates from Wollongong High school, I have also old passports which show the entrance and depature to and from Australia. If I supply them with these copies will they except them?

3rd Question In both forms they are asking " how many people are migrating with you"
To my knowledge if you are a Australian citizen (with passport) you are not migrating, so what to you answer?? in our case we are all traveling to Australia but only my wife is not an Australian citizen.

Evidence that our relationship is genuine and continuing. We have been married in 1995 we have two bank accounts which we share my tax declerations shows both of our name and our children, what other evidense must we provide. We are from a small Greek island and the Australian friends and relatives do not visit us every year. Do we need to fill out the "Statutory Declaration Form 888" and if Yes who can fill the form out
a cousin , freind, bestman, who?

I think i`ts enough for today. You have helped me enough just by replying to me and I thak you,if it is not hard for you please jot down when you reply to me the telephone number of the person you called in Berlin.

You ought to have a look at Evidence of Dependency and then the Booklet #1 as to the type of information required re commitment to a relationship.
Being married since 1995 and having children, it should not be a problem but still just respond as suggested.

Also in Booklet #1, information on cerifications, translations and statements starts at Page 27 - http://www.immi.gov.au/allforms/booklets/1127. so have a read of all that.
Essentially, a translation needs to be done by a person in Greece who is registered as a translator.
Likewise, it is whomever the government there authorises for certifying copies.

2. Re your residence in Australia, it is more your recent residence that Immi would be interested in and that probably more applies to someone who is a PR rather than a citizen, however copying the ID page of the last passport you used to exit and making a statement on when you last left will probably be sufficient.

3. Re the children, it may seem odd especially seeing as they are already citizens and as such are not technically migrating but in the notes on the application form - http://www.immi.gov.au/allforms/pdf/47sp.pdf
You will see

It may be that the children do need to be mentioned and even a form 47A filled in for them, perhaps even they needing also to do a medical, not so much to be able to move to Australia but merely because they are the children of your wife.

That is one question you could raise with the Immi people to see if the 47A and medicals are required for your children.
