Character Requirements

Hi all,

We have just been sent the paperwork for my partner's Permanent Residency, and I've got a question for you all about the Character Requirement.

He has a small history of being in trouble with the law for things like being drunk in a public place. He was in court in Ireland, and fined twice (no court) in Scotland, but all when he was 16-22 years old. No mention was made of any of this when he was granted the Temporary Visa.

He is 26 now, and just this year got another fine for being drunk in a public place. I'm wondering if you think this will have an impact on the PR application being granted?

Hi there,

If those offences were mentioned when he applied for the temporary visa, and DIAC didn't bring them up when making the decision to grant the visa, then it won't be an issue when he applies for the permanent visa.

Only offences that led to jail time of more than 12 months are of concern, as I understand it. Small petty crimes when he was below the legal age are not a problem either, I think. Take a look on the DIAC site for information about the character assessment.

If they are asking about any criminal history or convictions in what has been sent out to you, it just to be answered as asked and if it requests detail of any convictions and there has not been a conviction recorded you do not need to put anything down or if a conviction has been recorded, details need to be stated.
If it asks for any details of any court charges/fines then the answer should be in accordance.
