Question Company sponsored visa (ENS 856) - small business?

Hi all,

Does anybody know if there is a restriction in term of size of a company that can sponsor someone?

My partner's boss wants to sponsor him for a PR, but they are not sure if they can. Although he has sponsored him for a 457 so I am guessing the eligibility from the employee side must be similar?

All I can find on the immi website is this :
*be actively and lawfully operating a business in Australia
*have a genuine need for a paid employee to fill a position in their business
follow all relevant Australian laws and have a satisfactory record of meeting immigration laws (if applicable)
*have a current training strategy for existing Australian employees, or if a newly established business, have a training plan for future training of Australian employees
provide the employee with an offer of permanent employment.

The only thing that could be an issue is the training strategy, as they are a 2 persons business, so really small company.

If you follow all the links re eligibility for employer and employee you will find there is further information in regard to employer obligations and details on eligibility for both.
The application forms and Checklists also usually have more detail too so worth reading the notes on those as well.
