Defacto Visa Advice

Hi guys,

I met my partner in whilst traveling in Peru last year, she is from Germany and I am an Australian citizen. We knew each other for 5 weeks overseas then were apart for 4 months before she came here for 1 month in Feb 2011. She has returned to Germany, meaning we'll be apart for another 4 months before i go there for 2 months, then she comes here for at least 1 year with the WHV.

I have 2 questions:

1. Can we say that we were 'living together' from when she was here in Feb, and therefore be able to apply for the defacto visa in Feb 2012, and;

2. Is it worth asking my landlord to put her on the lease now even though she won't be back here til September.

Hi,

In my opinion, you would not meet the 12 month requirement because you need to have been living together on a permanent basis. DIAC will not accept the couples of months you spent together as actually living together.

You're better off waiting until she comes on her WHV, racking up one year and then applying onshore. As for the landlord, I doubt he would let you put her name on the lease when she isn't even there yet.
