Question Irish tourist travel to OZ after Offshore Visa App submission

Hi there

We are currently living in Ireland- my Irish partner has recently submitted a de facto visa application for Australia offshore in London, and we want to travel back together in OZ before the visa is approved (assuming that it will take 6 months to process given the current timeline updates).

Wondering if anyone (Irish in particular) has experienced any issues with entry into Australia on a Tourist Visa whilst an offshore visa application is in the process of being approved?

We know that he will have to leave again to have the actual visa issued, so a trip to NZ will hopefully allow to this.
But - I have heard that it is possible for immigration to refuse entry due to the fact that they believe the intentions to stay are not for tourist reasons as there is already a defacto visa in the pipeline.

We are desperate to return to OZ as soon as possible - any information or advice on how to tackle the re-entry would be appreciated.

I had applied for a prospective marriage visa in Berlin. I am Greek. I spent the last 3 months in Oz and a week after I got back I got my visa.
Make sure to notify your CO and it will be for your benefit if you have a ticket booked to leave Australia or sufficient evidence that you intent to do so after your visitor visa expires.
But your CO or the embassy in London will give u all the details u need.

Hi Suz,

How long ago did you apply to Australia House for your partners visa? My Irish partner and I applied in Dec '10 and got it finalised last Fri.

Just asking as they were very good at giving us a pretty accurate estimate of when it would be finalised (they estimated mid May in our case) and then in the end it would've been earlier but my partner's garda check was processed on 21/6/10 and as such we would have had to enter by 21/6/11 but we had stated that our plan was to return late Aug/early Sept (as we are going to NZ for a month for the rugby to there was no point coming home to find work and then having to tell employers we wanted a month off) so the CO kindly called us on 12th April to say that the visa was good to go but if we wanted to stay we would need an updated garda check. So after the estimate they gave us they would've completed it earlier had we wanted them to. That said our application was very straight forward, we've been a couple for over 4 years, living together for over 2 years, have had a joint bank account for a large part of our 4 years together, leases, bills, etc and submitted police and health checks prior to applying so it was all a pretty straightforward and comprehensive application and i think that made a difference. Of course everyones situations are all different and i get the impression the CO's use their own discretion a lot of the time. Did you tell the CO you wish to return to OZ before the application is finalised? If so they'll hopefully give you a heads up and let you know when it is close to being finalised so you can make your plans to exit when it is being finalised.
