489 visa query

My sister and her family are looking to apply for 489 visa and I will be the relative sponsor in the designated area. I want to know if 489 visa holders are eligible for Medicare. Also they have a child under 6, is he elibigle to enrol in public school without incurring any fee or is he classified as international student and have to pay for tuition fee? Many thanks

489 visas are temporary visas so no, there is no Medicare coverage. I'm not sure if there are additional school fees similar to 457 visa holders, but it may be the case. It would depend on the state they move to.

Hi,

I can confirm Maggie=May's comment. Different States have different policies on whether they charge temporary visa holders fees for sending their children to school.

You can check on the internet with education department of the State you are moving to.

Dear Experts,

I need your valuable advice on 489 Family Sponsor visa.

I got invite for 489 FS by claiming 10 points for my real brother.He is presently living in Victoria.

My query is that is it any requirement that your sponsor should live minimum of 1 year in location from where he is sponsoring you?

Because he was lived in Victoria on student visa in 2006 to 2009. Then he moved to Brisbane and came back to Victoria since April 2015 i.e. since last 8 months.

Please guide me can I lodge visa or not ?

I don't believe there's any minimum time he'd need to live in a designated area before he can sponsor you.

Your relative has to be "Usually resident in a designated area of Australia (R489.225 (3)(c)).

In considering whether the sponsor is usually resident in a designated area (489.225(3)(c)), officers should consider the sponsor’ actual physical residence, that is, where they eat and sleep and have their usual abode, noting, however, that a person may ‘reside’ in more than one place. fficers should look for evidence such as:

the person’s physical presence in a designated area

the length of that residence

whether that residence has been lawful or unlawful

where they eat and sleep and have a settled home

the person’s intention to make or not make their usual home in a designated area.

A sponsor who has been living in a designated area on a temporary visa but has only recent acquired permanent residence, they may still satisfy the requirement that they are usually resident in a designated area.

Thank alot for insight on the query and brief explanation Sir...actually my younger brother lived in Victoria (area specified as designated but be was not having PR visa) on student visa and from 2007 to 2009. Then he moved to Brisbane (area not specified as designated) and now he moved to Victoria to settle down permanently since Jan 2015 (however he left Victoria and trevelled to his home country for Vacations and to meet family). However, he updated the his address details like mobile bill/driving license etc in April 2015 (after his vacations) and since then he is living there and working in an organisation on 35hr/week.

Please advice me when can he sponsor me for 489 FS visa ? Its in Jan 2016 or April 2016 ?
