Applying for PR visa and entering Aus

Hi,
My partner and I have been together for 10 years, living together full-time in the US since Feb 2008. She is going to apply for a PR visa, not a TR visa since we have been together so long.

I know that we can apply offshore and be onshore when the visa is approved. I have a question:
Once it is approved, if we in Aus, does she have to go out of the country and come back in?
Also, do PRs usually take longer than TRs?

Hi there,

If you plan to apply for PR straight away, you need to formally request it in a cover letter stating a brief reason why. Although it's in the partner booklet, not all case officers automatically consider it, so best to state it at the beginning.

Once it's granted, I don't think she will have to leave again. The processing time depends on the office you lodge in. I don't think the processing time is that different, but you should inlude as much evidence as you can to show the length you've been together, otherwise if they request more evidence that could drag things out a bit.

I was reading the sticky post by Wanderer about entering Aus during visa processing, which has me a bit worried.

Maybe the condition that says you can apply offshore but be onshore when granted doesn't apply unless she has a visa thats not a tourist visa? I'm only guessing in my interpretation but I assume the issue here is that, for her to get onshore, she would have to say that she was coming in as a tourist (which wouldn't be truthful). Wouldn't it be the same for people who apply while in Aus on a tourist visa? I can't imagine Immi being too happy when you apply for TR/PR a week after you telling them you came for a holiday.

Any ideas??

Hi again,

I think that you would have to call your nearest Australian embassy and find out for sure how to go about it.

Usually, if applicants lodge offshore for a temporary visa (309), but want to travel to Australia during the processing to be with their partner, they inform DIAC in the cover letter so that the CO knows and can advise the applicant about the visitor visa requirements. Then, the applicant has to leave Australia before being able to get the partner visa once it's granted. But, I'm not sure what the case is with applicants who lodge offshore that meet the criteria for grant of PR straight away.

It's just occured to me that even if the case officer said your partner were eligible for getting PR straight away, the fact that the tourist visa would have a no further stay condition on it would mean she would have to go out of Australia and come back in to get it anyway.
