Smile visa 820 broken down

hi guys i came to Australia 2 years ago on subclass 300 visa . i'm currently on 820 visa but my relationship has broken down 3 weeks ago. we did try to work things out but we now realised that we cant be together anymore. we still friend, we don't hate each other, my ex partner doesn't want me to go back to my country either. I have fallen in love with australian life. I already gave up everything to move to Australia. I have a good job here in australia. im a disability support worker. but in fact we cant continue the relationship and apply for PR visa. I received an email from DIAC 3 days ago regarding applying for permanent partner visa.im just not sure whats the best to do. Is there a possibility for me to get a working visa? thank you

You would need to check the SOL and CSOL lists to see if your occupation is on the list.

You are obliged to tell DIBP that your relationship has broken down. They will then give you 28 days to either apply for another visa or to leave the country.

I am sorry that your relationship has broken down. If you required to notify DIBP. If you don't you are your partner and committing fraud.

I think u should wait until u get pr and break up after that as u already invest time.

Rose Mary this is against the rules of this forum. We do not promote immigration fraud.

FYI - any type of fraud can result to fines and/or jail time.

You sign a Statutory Declaration saying the relationship is genuine and continuing.

So she has to go home as her skill is not in occupation list in demand so she can not apply for work visa here .

A partner visa is based solely on the partnership, and it is fraud to get PR based on a relationship that is not genuine and continuing. And fraud makes the process for those still in genuine and continuing relationships that much harder and longer. To the original poster whose relationship has failed, I'm truly sorry for that. Thank you for respecting the rules of immigration and the law you agreed to when you submitted your partner application, and reporting the breakdown of your relationship. I believe PR is still a possibility even if the relationship breaks down (I remember reading something about that in the partner migration booklet but can't quote it) BUT you still have to report the breakdown and work with DIBP to determine if appropriate conditions are met or not.
