partner visa enquire.....

i have applied for the 820 visa and now waiting for the outcome, i handed in the evidence of my wife`s pregnency.(delivery on sep 2011)
i just handed in my application on march 2011.
i want to know if my application is succeessfully assessed. which visa i will get? 820 or 801...

Hi,

The partner visas are a two-step process. So, when the application is granted you will get a subclass 820 visa. Two years after you lodged the application (i.e. 2 years from the date you lodged, not when it was granted) you will be up for a review of the relationship again, which will give you PR on the 801.

So, when you lodged the partner application, you automatically applied and paid for both steps. DIAC will contact you at the 2 year mark, so you don't have to worry about it unitl they send you information about preparing the second stage.

I didnt reply to this thread because your case is a little more complex. I think in this case Aussiegirl may be incorrect but I am not 100% sure.

There are a few cases where 801 is issued straight away without the 2 years waiting period which include being in the relationship for 3 years or longer. another reason is if you have kids together. because your wife is pregnant it may impact the decision on your application.

Hi,

Yes, I have also read that you can get PR straight away if you have been living together more than 3 years, or you have been together two years and have a child.

But, if you want this to be considered, you have to request it formally from DIAC when you apply via a cover letter. Not all COs automatically consider this, and if you don't tell them straight away, it's hard to turn back the wheels and reclassify the application once it has been processed as just stage one.

actually , i have a little bit confuse about the cover letter. can i download it from DIAC website? or i need to get the letter from my doctor. because i have handed in the application with the doctor`s proof of pregnency of my wife since March 2011, as you said, if i need this to get the key consideration of my PR application. how can i do to make it under CO`s decision.

Hi Handis,

You can't get a cover letter from DIAC. It's something you have to type yourself, like a business letter. You should have put one on the front of your application, but if you didn't it's not a big problem.

But, you should have told immigration that you wanted to be considered for PR at the moment you applied. It's already been around 3 months since you applied, meaning it's already gone through certain stages of assessment.

At this stage, if you want to be considered for PR, contact your CO and tell them that you had not realised it was an option at the time of applying and could you please be considered for it. It's up to the CO if it's possible now or not.

i think i need to wait half year until the co want me to provide more information to process my application.
actually, i can`t apply my mum to come to aus as "family sponsor visa" due to my student visa.
because i want my mum to take care of my wife during her pregnancy. However , immigration rejected my mum` application, i think that if i have got PR i can apply "family sponsor visa" for my mum to come to aus.
how i can do ? tks for Aussiegirl again..
