Smile 47SP Marriage Document Missing ! Can we proceed?

Hi,

This is my first post, as I've just joined today. I hope someone can help me! :-)

My fiance (Oz citizen) and I (Scottish) are getting married in Aug 2011, but we plan to apply next week! Hopefully before the price increases and the forms change!

We are currently completing the forms for the Partner Visa application and noticed that the checklist on the form 47SP asks for Marriage certificates AND Divorce documents.

We have both been married & divorced before and both have the divorce documents certified. But we don't have the original marriage documents!

Will this make a difference as all the details are on the divorce document?

Hi and welcome,

If you look at the requirements for the vias, it says that copies of major documents like marriage certs., birth certs., etc should be certified copies. So, just get copies of your marriage certs. certified. But, your divorce certs. are the only copies you have right now, so maybe you should explain this in your cover letter and request that you have the certified copies back once they have looked at them.

DIAC are meant to give back documents once they have finished assessing that particular requirement, so you should be able to get them back.

Hi,

That's great advice.

I think we will request the marriage certificates and get them certified.
I also think we will put in the application next week and add an explanation why the marriage certificates are not there and tell them that we will fwd on when they arrive.

Hope this doesn't hold up things too much.
