Onshore Temporary and Permanent (Subclasses 820 and 801)
I have some questions that i hope can be answered. Please forgive me if they seem uninformed, but i haven't really understood everything about these visas.
So the situation is, I am an Australian citizen that is married to an American citizen. We have been married 18 months, with us living together in the U.S for the duration of our marriage to date.
I understand you need to be offshore for an offshore visa, and onshore for an onshore. Are we able to apply for the visa as an onshore visa if my wife comes to Australia on a tourist visa and we send in our application? Being married we obviously just want to be together, and if she can be with me while the visa is in process that would mean an awful lot.
Can anyone shed some light on this for me?
Simon and Janet.
She would have to be in Australia on a substantive visa, e.g. A student visa, working holiday visa. Have you looked into working holiday visa's?? The only thing to be wary of is Immigration don't like you coming to Australia on one visa in order to apply for another. I initially came out on a WHV for a year, to see the country, see where my partner grew up and to generally just have a break after I had finished studying, I had a return flight booked and we were planning on returning to the UK after my visa was up but It didn't take us long after being here to realise that this is where we wanted to be and so we applied for a de facto visa onshore.
Hope this is of some help!!
You might want to apply for the partner visa first (offshore) and then apply for a tourist visa, but your wife has to leave after the tourist visa is up.
Alternatively like Tjw25 said, you need to apply for a substantive visa (working holiday, student etc) move to australia and then apply for the partner visa onshore. This second one may be the best one if you want to stay together but be aware once her substantive visa expires she may be on work restrictions on the bridging visa.
