DUI after lodging Permanent Residency

Hi Guys,

Please help me out with this.

Few weeks back i was charged with mid range DUI, my court date is on the 16th dec 2014 and i had lodged my Permanent Residency just 1 day before the incident.

Do i need to notify the immigration ASAP or wait until my Case Officer is assigned and then disclose it to them. Plus i have had no records at all in the past my history was all clear and i had also submitted the Police report with a clear history.. do i need to do another police check?

I am sure my licence would be suspended and have to pay penalty, will this affect my application or will it be delayed..very stressed please help

You will need to notify a change in circumstances to your case officer. Best to wait until after the court case so that you know the penalty. It shouldn't make any difference to your PR application.

Best to get another Police Check reflecting the incident.

The main reason for bringing things up to date is that you will be asked if you have ever had a police record when you land in Australia, and every time you re enter Australia. If you update everything, then you can always answer truthfully without any fear of repercussions.

My advise is that leave it as is. It's gonna delay everything! That is not a capital offense.

Zeld . it is obvious that you are unaware of visa cancellation clauses and the potential sanctions for not providing up to date and correct information. That is the silliest and most dangerous advice I have seen on this site.

Hi Jeremy,

Thankyou for your help. my licence was suspended for 6 months and fined 1500$..
But 1 question the magistrate didnt mention anything about criminal conviction, would that be a criminal record automatically?

I am not sure. Best idea to either look up the criminal code (Google) or ask a lawyer.

I have pr and I got one too. You can ring your case officer and ask what you should do. Good luck my court thing is coming up.

Guys Thanks a lot for your answers.

I was charged on the 16th Dec 2014,,fined $2000 and 6 months licence suspension. I had filled out a form for traffic offenders program for 20th dec. havent paid anything its a non recognised course at parramatta.for 1 day.PCYC offers recognised Traffic Offenders Program 6-8 week...1 day every week..

I had submittted the form for non recognised Program in the court which i hadnt started it,,but i was convicted on 16th Dec.So do you think i should attend the program thats tomorrow...the judge hasnt said anything about it

Please help
