Exclamation Need help pleas

Hi thanks for that forum !
im from israel and me and my fiance applied for a subclass 300 prospective marriage visa six months ago ..... today i received the REFUSE from the immigration in Israel , they saying that there is not enough Evidence to grant the vissa .... any way im so desperate because she live in Australia and we can't stand the separation any more its so hard !!!
My question is is there any other way i can marry her ? without the prospective marriage visa ? for example what happened if she come here and we marry here or marry in new Zeeland .

Hi Psyruse,
If you marry in Israel or NZ you will still need 2 apply for another spouse visa, marriage doesn't automatically gives you the right to migrate to OZ, you will still need to prove your relationship is genuine.

Did you submit all the right papers? how long have you been together? do you have a joint bank account? mutual property? did you have stat declarations from friends and family? how did you do on the interview? what were you asked?
You may be able to appeal, or just try again, but you need to figure out what went wrong, did you use an agent or did it alone?

P.S: 300 visas are also "caped" that means that the government can put a limit on how many of these will be issued every year, spouse/De Facto visas are not limited by number, so maybe she should come and live with you for a while and then you can try again and file for the spouse visa? perspective marriage visas are more tricky and sometimes harder to prove.

yes i just figure it out that we can marry but still will have to go trought the proces of vissas and immigration its so annoying!

me and my fiance are together for almost two ears ,but because of this vissa problems i didn't saw her as much as i wanted to about one and a half monts in Australia and she and har mother come to visit me and my family for six weeks in Israel (not much but i truly love her ) , yes i did submit all the documents ! but they say its not enough , because we dont have a joint account ,we dont have a mutual property (its funny i could we have if they don't let me go and be with her ! ) and also the interview went wrong ,they wasn't happy with my answers and we had different answers to their questions things like :
1.where did you buy the engagement ring ?( how should i remamber? it was two ears ago! )
2.did you gave her the recite ? ( i said yes but in the and it was different time when i gave her the earrings ... and she said she didn't receive any .....)
3. was she alone when you met her in the shopping centre ? ( me : yes ..... wrong! she said she was with her mother ... its true she was shopping with her mother but when i met her her mother wasent there ... ) stupid mistakes like thous ...
well people make mistakes dont they ?

so they think its all bull sheet now and we need to suffer from that ....
i didnt took any agent , and i dont know what to do now im despaired and i dont know how can we fix the situation ! i know i can appeal but now we have to waste more money (that we dont have ) an wait much more time and no one say it will work


ps : sorry for my english mistakes !

Ok, it sounds like a lot of stuff went wrong with you'r application, and I do mean A LOT!
My best advise right now will be: have her come over to Israel and really live together for at least several months, maybe even get married, open a joint bank account, share you'r life, you'r home, you'r bills, show her Israel, it's a gorgeous country after all, let her meet all you'r friends and family, just take a break from all the bureaucratic hell and be a normal couple for a while.

Is she Jewish? will she have working rights in Israel? if so it might make things much easier for you. In the meantime you can work and save some money for the visa, the tickets, the move, the wedding, the whole thing, and do it together, as a couple.

Then, after a while try again, you will have stronger evidence and a stronger relationship to go with it, if you really love each other you will find a way to work it out.

No-one can stop you getting married, you are entitled to marry whomever you like but you can't automatically get a visa just based on marriage. As Mari said get married in your country and build a life together and document it all the way so you have solid proof for you next visa application. Prospective Marriage visas are actually easier to get because you don't need so much physical proof, ie. joint bank accounts and other financial commitments like a house etc. If you had trouble proving prospective marriage then you need to be extra careful to prove spouse. Joint bank accounts, Will, lease or home loan together, invitations to events from family and friends as well as all the plans for your own marriage, keep everything, every document and every receipt. Unless you have good grounds for an appeal (ie. you can address every item they faulted you on and give proof) then you will waste a lot of time, appeals take forever, it is actually quicker to make a new application, but make sure it is a strong one.

that might work .. then you have to apply for the 309 instead.... yeah its painfull to be without your wife..
